I think the Court is going to side with the Government. But Trump will not get tried this year on the insurrection charges this year. It appears the Court is trying to come up with a rule to determine whether a President is acting in an “official” capacity. That means a test will be arrived at, and the case will get sent back for a finding according to the test — which will allow for another appeal.
