OT: Advice Disputing False Damage Charge with Hertz Car Rental

They are trying to charge me $3800 for damage to a vehicle I rented when I know unequivocally it was damaged prior to me renting it.

the rental shop at the Miami airport was swamped, they told me to take a car without them walking it or filling out any damage assessment. I saw the damage to the tailgate but didn’t think to photograph it as we were in a hurry.

They can’t prove I damaged it, because I didn’t. They won’t provide the rental and damage assessments from before my rental, which would prove it was already damaged. They say it’s “sensitive info”. That’s bs. They probably just don’t have any of that paperwork either.

they also waited 3 weeks after I returned the vehicle to file a claim and send it in for repairs. How can they be sure it wasn’t damaged by someone else during those 3 weeks?

they are just trying to pin the damages me when they can’t prove anything.

how do I dispute this? How can I force them to provide whatever proof they have?

I’ve called the credit card company (capital one) but they can’t do anything yet as hertz hasn’t run the $3800 damages on my card yet.

I declined the damage waiver thing at check out so that’s not an option.

Im furious and want these phuckers to pay!

lesson learned - always walk and photograph the vehicle at pick up and drop off. Don’t be like me. Don’t become a statistic. Learn from my naivety. Adapt and overcome.
