President Trump’s personal lawyer Michael Cohen reportedly plans to plead the Fifth Amendment in his legal battle with former adult film star Stormy Daniels over her alleged affair with the president more than a decade ago.

Daniel’s lawyer, Michael Avenatti, told MSNBC’s Nicole Wallace that Cohen plans to file a motion to stop the case just days after his office, home, and hotel room were raided by the FBI to gather information on the case as part of special counsel Robert Mueller’s investigation.


“We’ve learned moments ago, within the last two hours, that Michael Cohen will be filing a motion tomorrow in our case, an emergency motion to stay — or temporarily stop — our case,” Avenatti said.


Cohen allegedly paid Daniels, whose legal name is Stephanie Clifford, $130,000 in exchange for her silence about the affair she claims to have had with Trump. She is now arguing that the nondisclosure agreement is invalid since Trump never signed it himself and is suing both Trump and Cohen for defamation for publicly calling her a liar about the incident.

Avenatti further explained Cohen’s intention behind filing the motion is that he plans to plead his Fifth Amendment right against self-incrimination if the case goes forward, which he called a “stunning development.”

Daniels and her lawyer plan to oppose the motion and continue working with the officials, arguing that Cohen knows “where a lot of bodies are buried.”

A lawyer for Cohen told The Daily Beast that Avenatti's claims are "inaccurate" and that he has not decided whether or not he will invoke his Fifth Amendment rights.
