Tough in that I have some sympathy for the 82 old man with the gun given the circumstances he was in but there is no way he is going to be able to justify self defense. He has a gun in the woman's face and she is retreating. Unless he goes for some kind of diminished capacity defense he may very well be living the last years of his life in prison.
