If Trump was to pardon all of the bad actors that rioted at the Capital or give them some form of asylum, what happens at that point?. I did a little research on this because of the fact that those crimes are federal and DC is not an actual state that would allow double jeopardy of state laws to apply. If Trump did pardon those guys of the federal charges it will then be up to the DC city code officials to act. This is where it gets tricky. That particular exception can be changed at any time by congress and there may not be code definitions to match the federal charges. So in theory, those people would be free to go for an extended period of time if there is nothing to charge them with under the DC Code.
