My daughter was fired as a Teacher Assistant from a school where her two children (my grandkids) attend school. The primary reason for her being fired was a dispute she had with the Principal over how a student should be disciplined. I will not get into the details of the dispute other than to say that my daughter stood her ground about what she believed was best for the child and as a result was deemed by the head of Human Resources at her district as being a "problematic” employee. Since her position was one where they did not have to show cause for termination she was let go.
Let me emphasize at this point that before she was employed by the school she was a member of the PTO at that campus and volunteered regularly at the school to sell concessions, monitor assemblies, and help with the school book fair. After her termination, she was asked by one of the teachers at the school to be a judge at the upcoming Science Fair which she gladly volunteered to do. Today she was notified by that teacher that her Principal told her that HR has deemed that my daughter cannot volunteer for anything unless it is in her children's classrooms, nothing that would require her to be among the general population of the school which included the school science fair.
My daughter has never threatened or intimidated anyone on that campus as a parent or employee but has talked to some faculty members and other parents about her firing since she still has to be at the school to drop off/pick up her children. Nobody from administration ever gave any explanation to the faculty/staff for why a TA who had contact with almost every student in the school was no longer there.
My questions are: can the school discriminate against a parent solely for being a former "problematic" employee and not allow her to have the same opportunities to volunteer at the school like any other parent? Does HR have any say on what a parent can volunteer for on campus when that parent is no longer an employee of the district? What can my daughter do to regain her rights as a parent to be involved in the school?
