My mom’s husband suddenly passed away last week. I will be helping my mom navigate probate so hoping to get some advice. No will has been found and I highly doubt he had one knowing him (a mistake).
Here are the circumstances:
Married to my mom 2 yrs ago after 7-8 yrs together
He has a daughter that just turned 17
Daughter’s mom has already inquired about a will…
Assets include:
Land/house acquired after they married
Truck, construction tools, tractor - likely all acquired before they married
My mom wants to move out of the property and closer to family
There is not much money here and I am already fronting the funeral costs. My siblings and I will need to help support my mom going forward so anything she can get from the sale of house and other property will lessen the burden for us.
Questions:
Do you have a recommendation for a probate attorney in Comal County?
Should we wait to sell the property when the daughter is 18 (as she would have to agree and is still a minor)?
Can we start to sell personal property to pay funeral costs and other debts?
What is the breakdown on split for my mom and his daughter house and his separate personal property?
