Rental commercial location in Arkansas where I have been a tenant since 7/1/24. The unit did not have a working air conditioner at the start and landlord agreed to install at start of contract. He did not have air conditioner installed until 5 weeks later. On October 13 th a drunk driver ran into the ac unit and destroyed it. The driver did not have insurance. The landlord was provided with all police reports and has been in contact with police. The prosecuting attorney has spoken to landlord to get his damage cost report, but he refuses to comply in providing them the cost report. I have continued to pay full rent. To clarify the total rent covers 2 adjoining units that are separate. The one damaged ac unit operates for the back separate space. The landlord has repeatedly told me he will have someone out to repair, but over near 3.5 months has failed to do so. In my contract I am responsible for maintenance and repairs of air conditioner. Does damage like this fall under maintenance/repairs of which the tenant is responsible since it was a drunk lady hitting it or is the responsibility on the landlord and his building insurance? In the full time of lease I have been without a working air conditioner for 4.5 months of the 6.5 months lease thus far. Would this allow for construction eviction?
