Real Estate Question. Neighbor's retention wall is on my lot.

Need OBs wisdom here. I'm purchasing a vacant lot in Lago Vista. Closing scheduled in the next few days. Next door the builder put up a retention wall at the back corner of the lot using large limestone blocks for a home currently under construction. It's a beautiful home by the way, however nearly all of his retention wall that runs adjacent to my property actually sits on my property. It's clearly marked on the topographic survey I ordered.

Not trying to cause a fuss at all. Can I assume if I just send him the survey that he will then have the retention wall moved? Or should I expect something else? Just hoping to tap into anyone's experience with this type of thing. Thanks in advance.
