Well, of course it was challenged and is now in the appellate court. The Trump administration is arguing that the president has the unilateral authority to spend federal funds without congressional oversight. The judge put the DOJ attorney through a series of hypotheticals on this theory today. The attorney was asked:
“After the defeat of a healthcare bill, the President of the United States instructs the Treasury to pay for healthcare insurance for any American who cannot get private insurance, would the Congress have standing to challenge that?” “No Your Honor,” the attorney replied.
Is this not the greatest? The next Democratic President can institute Medicare for all and maybe redirect a huge chunk of the military budget to fighting climate change with just his pen. Can’t wait.
Some would posit that Trump’s argument shreds the historical view of the Constitution’s separation of powers, if not the literal words but that would not include the Trump cult. No siree bob, they were here telling us that Trump’s actions to subvert Congress was just owning the libs. Now all that’s standing in the way of having an all powerful executive (possibly named Biden) are the courts which Trump and McConnell are busy stacking as fast as humanly possible. Isn’t this special?
