This current stuff is HS rumor (“we don’t like him, let’s start rumors”) BS that doesn’t involve a superior/subordinate relationship.

Major's affair was a matter of public (university) record as the student trainer listed it on her job application. That's not like rumors about KS.
 
They may still negotiate the buyout of there is anything to the Kendra Scott rumors. He would never want to be deposed on it when it will be likely be a public record. Kendra would pay the buyout herself, unless Tom is already leaving Michelle for her.

I doubt he had an affair with a high profile celebrity. And I doubt part of his contract said “Don’t have affairs with high profile celebrities”.

Find one unfounded rumor here and one unsubstantiated anonymous post there and Bingo! You’ve created a crisis.

I don't think Michelle "finding out" is an issue.
 
The affair is not the best weapon in their arsenal if they choose to go that direction.
 
I am not saying there is anything to the rumors, but, if there is, it could certainly be used as leverage. It definitely could be argued that his focus and attention was elsewhere, along with his penis and it affected his performance. The morality clause is in the contract for a reason. The ability to use it depends on how valuable this is to keep from the kids. If Tom wasn't so arrogant and hated, this wouldn't be an issue. Nothing serious was made of Major's affair while his wife was pregnant because he wasn't hated. I don't think Tom has the same goodwill.
LOL. Noone cares about infidelity except Preachers and people who were cheated on. Infidelity isnt even effective leverage in divorce court anymore so, it certainly has no place when it comes to contract law.
 
Buyouts are effectively pre-emptive litigation settlements. There is no way in hell either party allows any negotiation of a buyout to result in any sort of testimony or public statement of detail. It would negate the entire point of a pre-negotiated buyout.

Texas will pay Herman $15M or something very close to that. Obviously these sums of money for what amounts to failure can be up for debate and discussion. But that is a different topic.
 
Heard from an Mid level donor and someone else that they were looking into an alcohol clause in his contract several months ago.

Just what I heard and don't know if true or not, but it fits the TMZ nature of this thread so there you have it.
 
Ketch made reference UT has been trying for months to fire him based on cause. What’s the cause? I haven’t heard the rumors.


If UT did that in order to save $$, they would have lost their asses in court.

b.. I'm told Texas examined every means possible to get out of owing the buyout. Herman is gonna get paid.

It may not be to the betterment of society but, that doesn't change the fact that when it comes to contract law, it's not even really considered a violation of moral turpitude clauses which are set in place more for things like criminal activity or drug and alcohol abuse.
