Yes a 25 year old aide who is not in the presidential limo vs the secret service agents who were and are also calling bs, Sounds like a real brain buster determining who would be more likely to lie in that situation. This "fire in a crowded theatre" has been misused for 100 years. The case had nothing to do with fire or crowds. It was a terrible analogy by Holmes.

There are many Lawyers that get stuff wrong all the time, same as judges. If there weren’t then we wouldn’t have appeals. Pretty confident a tax lawyer knows very little about 1st amendment law. Why would they spend their time there unless it’s a hobby? El Martillo Tejano probably isn’t well versed in clear and present danger limits of free speec
Fire in a theatre is used wrongly to try and limit speech. It’s a Mandela if you will and has been for some time.
I’m no Lawyer or Constition scholar, but I read it (constitution) twice a year as my job. I’ve gone over Schenck and Brandenburg more times than I can count. I’ve read the opinions and dissents just as many times

FJB really annoys me with his criticism of the Supreme Court justices for their unwillingness to support the purported "will of the majority". Sorry but that is NOT their job. They are there to weigh the merits of cases against the Constitution.
Although I was disappointed with the Courts ruling on the "remain in Mexico" case yesterday, I can understand the ruling.
